Must Know

  • The 42nd Constitutional Amendment Act, 1976 added the Fundamental Duties. It created a new Part IVA, which holds Article 51A.
  • The Swaran Singh Committee (1976) first suggested adding these duties.
  • At first there were 10 duties. The 86th Amendment Act, 2002 added an 11th duty — parents must send their child to school between ages 6 and 14.
  • Fundamental Duties are not legally enforceable. No court can punish you for skipping them. This is different from Fundamental Rights, which you can enforce in court.
  • Fundamental Duties apply only to citizens of India, not to foreigners. Some Fundamental Rights, by contrast, apply to everyone.

In short, the 11 duties ask every citizen to:

  1. Follow the Constitution. Respect its ideals, its institutions, the National Flag, and the National Anthem.
  2. Value the ideals that inspired India’s freedom struggle.
  3. Protect India’s sovereignty, unity, and integrity.
  4. Defend the country and serve the nation when called upon.
  5. Promote harmony and brotherhood among all citizens.
  6. Value and preserve India’s rich, mixed culture.
  7. Protect and improve the environment — forests, lakes, rivers, and wildlife.
  8. Build a scientific temper, humanism, and a spirit of inquiry and reform.
  9. Protect public property and stay away from violence.
  10. Aim for excellence in every area of life, individual and collective.
  11. Give your child (or ward) the chance to go to school between ages 6 and 14 (added in 2002).
  • The idea partly came from duties found in socialist-bloc constitutions of that time. But India didn’t copy them — it adapted the idea to fit its own Constitution.
  • People call the 42nd Amendment the “Mini-Constitution” because it changed so much. Fundamental Duties were just one part of many changes made during the Emergency period.

Great to Know

  • Courts can’t enforce Fundamental Duties directly. But judges have still used them for guidance sometimes — especially Article 51A(g), the duty to protect the environment, which courts have cited while deciding environmental and public-interest cases.
  • Few democracies write citizen duties directly into their constitution. India is one of the few that do.
  • Fundamental Duties are often called the mirror image of the Directive Principles of State Policy (DPSPs). DPSPs are duties of the State toward citizens. Fundamental Duties are duties of citizens toward the state and society. Together with Rights, they form a two-way moral framework.
