What NALSA Is and Who Runs It

What NALSA Is

Core definition The National Legal Services Authority (NALSA) was constituted under the Legal Services Authorities Act, 1987. That Act came into force on 9 November 1995.
Why it exists Its job is to make the constitutional promise of free legal aid real — ensuring that people who cannot afford a lawyer still get access to justice.
Constitutional basis Its foundation is Article 39A, a Directive Principle directing the State to provide equal justice and free legal aid to the poor.
Mechanism NALSA plans and funds legal-aid programmes, then coordinates the State and District Legal Services Authorities that actually deliver them.
Result One national body sets policy; local authorities put it into practice across every district in India.

Leadership

Patron-in-Chief NALSA’s Patron-in-Chief is always the sitting Chief Justice of India — currently Justice Surya Kant.
Executive Chairman The Executive Chairman is a sitting or retired Supreme Court judge appointed by the President. Justice Vikram Nath has held the role since 24 November 2025.
Why this design Keeping judges at the top ties legal aid to the judiciary’s authority and credibility, so the scheme is not seen as a mere government handout.
Mechanism The appointment is made by the President, which gives the role formal constitutional weight and continuity.

The Three-Tier Structure

National level NALSA sits at the top, co-ordinating legal-aid policy and programmes across the country.
State level State Legal Services Authorities, headed by High Court Chief Justices, run legal aid within each state.
District level District Legal Services Authorities, headed by District Judges, actually deliver legal services on the ground.

How It Delivers Legal Aid

Who Qualifies for Free Legal Aid

No income test Section 12 grants free aid to SC/ST members, women, children, persons with disabilities, and victims of trafficking, begging or disaster — with no income test.
Income test Others qualify only below a set income ceiling: below ₹1,00,000 a year for a general-category person, and a higher limit for a transgender person.
Why the split Vulnerable groups are eligible by status because their disadvantage is social, not just financial. Others must prove financial need to protect scarce public funds.
Common traps OBC status alone is not a listed category, and not every senior citizen is automatically eligible — these are the options UPSC uses to test you.

Lok Adalats

What they are Lok Adalats are people’s courts organised by NALSA for the speedy, amicable settlement of disputes.

Scale A single National Lok Adalat can settle over two crore cases in one day — far more than most courts handle in years.
Mechanism Because settlement is by consent, awards are enforceable and final, giving parties a fast, low-stress alternative to trial.
So Link Lok Adalats to NALSA’s dispute-resolution role, alongside arbitration, mediation and conciliation.

Key Milestones

1987 Act Parliament enacted the Legal Services Authorities Act in 1987; it came into force on 9 November 1995 after 1994 amendments, constituting NALSA.
2014 landmark NALSA v. Union of India (2014) saw the Supreme Court legally recognise transgender people as a third gender with constitutional rights.
Recent leadership Justice Vikram Nath became Executive Chairman on 24 November 2025, succeeding Justice Surya Kant.
Lok Adalat record Between 2023 and 2025, twelve National Lok Adalats disposed of around 26 crore cases nationwide.
