Once a product is sold, most companies stop thinking about it. One legal principle forces them to keep thinking about it, all the way to disposal.

🏛️ Must Know
Where Extended Producer Responsibility Started in India
  • The Definition Extended producer responsibility, or EPR, makes producers responsible for a product’s whole life cycle, including its disposal.
  • First Introduced in 2011 India introduced EPR as an important feature in the e-Waste (Management and Handling) Rules, 2011. These rules took effect in May 2012.
  • Not the Earlier Rules The Bio-medical Waste Rules, 1998 and Recycled Plastic Rules, 1999 both predate this. Neither one introduced EPR as a defining feature.
  • What Producers Must Do Under these rules, producers must set up e-waste collection centres and finance environmentally sound e-waste management themselves.

How EPR Has Been Strengthened Since 2011
  • Reinforced in 2016 The E-Waste Management Rules, 2016 further strengthened EPR obligations for electronics producers.
  • A Digital Portal in 2023 A 2023 update introduced a CPCB-run digital portal for tracking EPR compliance across producers.
  • Tradable Certificates This system now lets producers meet their recycling targets through tradable EPR certificates. This adds a market mechanism to the original rule.

Why EPR Later Spread Beyond E-Waste
  • Plastic Packaging Too India later applied EPR principles to plastic packaging waste as well. Producers became responsible for its collection and recycling.
  • A Shift in Environmental Cost EPR shifts the cost of end-of-life waste management away from taxpayers and municipalities. That cost instead falls on the producers who created the product.
  • Still an Enforcement Challenge Despite the legal framework, monitoring compliance remains difficult. Whether producers actually meet their EPR obligations is a real regulatory challenge in India.
